These Terms of Service (“Terms”) govern your access to and use of Craicko, including our website, mobile applications, and related services (collectively, the “Service”). By creating an account or using Craicko, you agree to these Terms.
1. Acceptance of Terms
If you do not agree to these Terms, do not use the Service. If you are creating an account on behalf of a business, you confirm that you have authority to bind that business to these Terms.
2. Accounts
You must provide accurate information when you register and keep your account details up to date. You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized use.
We may refuse, suspend, or terminate accounts that appear fraudulent, abusive, or in violation of these Terms.
3. Members and Businesses
Craicko serves Members (who collect loyalty stamps, rewards, and referrals) and Businesses (who publish offers, record visits, and redeem rewards). Each role has different features; you agree to use only the tools available to your account type and not to misrepresent who you are.
4. Offers, Visits, and Rewards
Businesses set the terms of their deals and loyalty offers. Craicko provides the platform to publish, track, and redeem them, but we do not guarantee the availability, quality, or fulfilment of any business offer. Disputes about a specific stamp, visit, or redemption should first be raised with the business; we may assist where appropriate but are not obliged to resolve every dispute.
You agree not to abuse visit recording, QR codes, referral links, or redemption flows (including fake visits, sharing credentials, or circumventing limits). We may reverse fraudulent progress or rewards and suspend accounts involved.
5. Referrals and Earnings
Where referral or commission features apply, earnings are subject to the deal terms agreed between Member and Business, applicable law, and our payout rules. Craicko may withhold, adjust, or reverse amounts that result from error, fraud, or chargebacks.
6. Acceptable Use
You agree not to:
- Use the Service for illegal, harmful, or deceptive purposes
- Interfere with or disrupt the Service or other users
- Scrape, reverse engineer, or misuse our APIs or QR systems beyond normal use
- Upload malware or attempt unauthorized access to accounts or systems
- Harass businesses, members, or Craicko staff
7. Intellectual Property
Craicko and its logos, design, and software are owned by us or our licensors. You may not copy or reuse them except as needed to use the Service. Content you submit (such as business descriptions or profile photos) remains yours; you grant us a licence to host and display it to operate the Service.
8. Third-Party Services
The Service may link to or integrate third-party tools (for example payment providers, maps, or email). Those services have their own terms and privacy policies; Craicko is not responsible for their practices.
9. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Craicko and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim, or (b) €50.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for fraud or death/personal injury caused by negligence).
11. Termination
You may stop using Craicko and request account deletion through the product or by contacting us. We may suspend or end access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (including liability limits and intellectual property) will survive termination.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes may also be communicated by email or in-app notice. Continued use after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Ireland have non-exclusive jurisdiction, subject to those mandatory rights.
